3. "Services" are all actions carried out by MI AMANTE LTD. in and/or in connection with the offering, sale and delivery of goods from this online store.
4. "Online store" - the present website www.miamantehair.com, which offers cosmetic and other products and services through electronic commerce.
5. "Customer" is any person who has placed or wishes to place an order through the online store on the website: miamantehair.com

1.4. The final price of the goods is stated on the presentation page of the respective product in Bulgarian leva. All prices listed on this site include VAT and do not include a delivery price.  Delivery prices are listed separately and represent the delivery amount of the specific courier company with which we have a concluded contract for cash-on-delivery deliveries.

1.5. When using the means of communication provided to contact us, there is no additional value charged.

1. In the content of the online store miamantehair.com, the registered signs and brands, photographs from the catalogues, texts, etc. of various companies are used, and the rights to these materials belong to the respective company. All other materials from the content of the site (including, but not limited to, photographs, graphics, text, illustrations and design) are the property of MI AMANTE LTD. Their use for commercial, advertising or other public purposes, use through public distribution, copying, publishing on other websites in the global network, the creation of derivative materials from the content of the online store, changes to the content, the transmission, display, reproduction of the content, the creation of secondary materials are violations of copyright and related rights and are prosecuted by law. For orders by telephone, the only possible method of payment for the goods is cash on delivery. It is assumed that when placing an order by telephone, the Customer has familiarised themselves in advance with these General Terms and Conditions, including the part concerning the protection of personal data. If necessary, the opportunity to familiarise themselves with these General Terms and Conditions, including the part concerning the protection of personal data, is indicated and explained to the Customer when placing the order by telephone.

IV. RIGHTS AND OBLIGATIONS OF THE PARTIES

1. The successfully registered user, as well as the one who places an order by telephone or an order through the website of the online store miamantehair.com, receives the right to order the offered products and services or to refuse them or return them in the proper manner.

3.1. To pay the price that was current at the time of placing the order, in accordance with the procedure described in these "General Terms and Conditions".

3.2. Not to violate the rights and freedoms of citizens, in accordance with all statutory and subordinate acts in the country and in European rules, including by not providing personal data of data subjects other than themselves.

3.3. To observe internet etiquette and the rules when using the products and services provided by  MI AMANTE LTD.

3.4. Not to infringe upon third parties' proprietary or non-proprietary, absolute or relative rights and interests, such as the right of ownership, intellectual property rights, the right to protection of personal data, etc.

3.5. To notify MI AMANTE LTD. and the relevant authorities immediately of any case of a committed or discovered violation in the use of the services provided.

3.6. Not to carry out malicious actions.

4.1. To refuse access and to cancel user registrations.

4.2. To refuse orders without any costs to the user. In this case miamantehair.com does not owe compensation in any way to the user, except to refund the amounts paid by the user in advance, when there have been technical errors in the publishing of information.

4.3. To edit the content of the website - such as existing prices, terms of use, products, services, information, photographs, etc. at its own discretion and at any time without notice. The new conditions take effect at the moment of their publication.

4.4. To use at its own discretion all comments, suggestions, ideas, etc., sent or proposed by the users of the online store miamantehair.com. They remain the property of MI AMANTE LTD. and in this sense the company is not limited in their use and is not obliged to pay any compensation whatsoever to the users for their comments, ideas and suggestions.

4.5. To retain materials and information used/located on the server on which www.miamantehair.com is located or made known to third parties by a user, and to provide them to third parties and the relevant state authorities in cases where this is necessary to protect the rights and legitimate interests, property and security of MI AMANTE LTD., as well as of third parties, in cases of claims brought in connection with the violation of their rights regarding used or distributed information or materials, in compliance with the applicable rules concerning the protection of personal data, as well as in cases where the materials or information are requested by state authorities pursuant to an explicit statutory provision;

4.6. To terminate, suspend or change the services provided at any time without notifying the user, when the latter uses the services in violation of these "General Terms and Conditions".

5.1. Has no obligation and no objective possibility and does not control the manner in which users use the services provided.

5.2. Does not assume any guarantee for the accuracy and integrity of the published information about the products.

5.3. Together with its suppliers or third parties, bears no responsibility under any circumstances for any damages whatsoever, including, but not limited to, damages from lost profits, from loss of information or others, arising from the use, the inability to use or the results of the use of the online store miamantehair.com. If, as a result of your use of the online store miamantehair.com, of products or services from it, damages arise on your part, you assume full responsibility and all costs associated with remedying the damages caused.

5.4. Bears no responsibility for possible differences in the colours of the purchased products, due to specifics in computer screens. The request to purchase specific products is taken as expressed consent on the part of the user regarding their type and quality.

5.5. Bears no responsibility towards users and third parties for damages suffered and lost profits arising as a result of the termination, suspension, modification or restriction of the services, the deletion, modification, loss, unreliability, inaccuracy or incompleteness of messages, materials or information transmitted, used, recorded or made accessible through the online store miamantehair.com

5.6. Bears no responsibility for damage caused to software, hardware or telecommunications equipment or for loss of data arising from materials or resources searched for, loaded or used in any way whatsoever through the services provided.

1. The advice, consultations or assistance provided by the specialists and employees of the online store www.miamantehair.com in connection with the use of the services by users do not give rise to any responsibility or obligations whatsoever for  MI AMANTE LTD.

V. GOODS

1. The goods sold are the property of MI AMANTE LTD.
2. The customer sees on the site miamantehair.com only the products that are available at the moment. If it happens that a customer places an order for a product that is not available, they are immediately notified by phone or email.

VI. PRICES AND CONDITIONS FOR DELIVERY

1. Delivery of products with a total value over 50 EUR is at the expense of miamantehair.com.
2. The delivery price for orders under 50 EUR is as follows: Delivery to a courier office  3.49 EUR, Delivery to a personal address - 3.49 EUR. The price does not depend on the number of products ordered. Standard express next-working-day delivery service is used.
3. Cash on delivery fee: the cash-on-delivery payment method requires an additional fee of 1 EUR, which you will need to pay upon delivery. Please keep this in mind when ordering.
4. Requirements for deliveries at a fixed time are charged at 1.20 EUR for parcels up to 5 kg. The fixed time is interpreted as +/- 15 minutes. The earliest possible fixed time is 10:00, the latest time is 16:30
5. Deliveries from miamantehair.bg are made only within the territory of Bulgaria. 
6. Delivery to an address is carried out by courier  from Monday to Friday between 9:00 and 17:00,  (Saturday until   14:00). Deliveries are not made on Sundays and official holidays.
7. The delivery time is from 1 (one) to 3 (three) working days from the date the delivery is dispatched. A temporary delay in the dispatch of parcels of between 5 and 7 working days is possible. MI AMANTE LTD. is not responsible for a delayed parcel caused by the courier company.
8. Orders placed after 16:00 on working days are processed on the next working day. All orders placed on Saturday and Sunday are processed on Monday.
9. The user is obliged to check whether the contents of the parcel correspond to their order before paying the price. By paying the price of the order and delivery and by signing the delivery documents, the user gives their consent to the type and contents of the delivery.
10. The order is received only by the person who placed the order
11. If the goods are not delivered for various reasons during courier delivery, the courier is obliged to visit the location a second time within the working day or on the next working day. The repeat visit is carried out after phone contact has been established between the courier and the person who ordered the goods. The repeat visit is not charged to the customer.
12. In the event of a prepayment made and the customer's refusal to receive the order within 7 days, the value of the products is refunded in the manner indicated by the customer, with the payment costs being at the customer's expense.
13. Due to failure to observe a delivery day and time set by the user, or in the event that the customer refuses to receive their parcel while payment has been made in advance, MI AMANTE LTD. undertakes to refund the value of the products, reduced by the paid delivery fee.
14. The customer has the right to cancel an order at any time.
15. In the case of an incorrect or missing product, the one desired by the customer is dispatched on the same or the next working day. An incorrect product is replaced at the expense of MI AMANTE LTD. In the case of an incorrect or missing product, the customer does not pay an additional delivery fee.
16. During certain promotions, the customer may receive the right to free delivery also for orders with a value of less than 50 EUR.
17. You can return a purchased product within 14 days from the date of purchase, with the enclosed receipt. The condition for return is that the product has not been used, is in undamaged packaging and has the labels of the manufacturer and importer. Transport costs are at the customer's expense. The money is refunded within 3 working days from the date the product is received back by us.

VII. SPECIAL CONDITIONS FOR HAIR-COLOURING PRODUCTS

Introductory provisions

This section settles the special conditions applicable to the purchase and use of products from the Mi Amante COLORI line, including the professional hair colour Mi Amante Colori, the Mi Amante Colori Oxigen oxidants, the Mi Amante Colori Color Save shampoo and the Mi Amante Colori Color Save mask.

These conditions are in accordance with Regulation (EC) No 1223/2009 of the European Parliament and of the Council on cosmetic products, the Consumer Protection Act and the applicable Bulgarian and European legislation.

In the event of a conflict between this section and the general terms and conditions for distance selling applicable to the miamantehair.bg site, in respect of the hair-colouring products the provisions of this section apply.

1. Age restrictions and mandatory warnings

1.1. The hair-colouring products from the Mi Amante COLORI line are not intended for use by persons under 16 years of age.

1.2. The hair colours from the line contain phenylenediamine compounds and may cause severe allergic reactions. Before use, the user is obliged to familiarise themselves with all warnings noted on the packaging and in the enclosed instructions, including the following mandatory warnings required under Regulation (EC) No 1223/2009:

• Do not dye your eyebrows or eyelashes.

• In case of contact with the eyes, rinse immediately with plenty of water.

• Do not use in the presence of a rash on the face or on a sensitive, irritated or damaged scalp.

• Do not use if you have ever had a reaction to a hair colour.

• Do not use if you have ever had a reaction to a temporary black henna tattoo.

• When applying, use suitable gloves.

• Hair colours can cause severe allergic reactions.

• Carry out a sensitivity test (Patch Test) at least 48 hours before colouring.

1.3. Failure to observe any of the stated warnings may lead to severe and irreversible consequences for the health of the user. The responsibility for observing them lies entirely with the user or the third party applying the product.

2. Carry out a sensitivity test (Patch Test)

2.1. The hair-colouring products from the Mi Amante COLORI line contain chemical substances, including ammonia and phenylenediamines (diaminotoluenes), which may provoke an allergic reaction even in users who have not previously shown such.

2.2. Before each use, including if you have used the product before, it is mandatory to carry out an allergic sensitivity test (patch test) a minimum of 48 hours in advance, in accordance with the instructions enclosed with the product.

2.3. In the event of redness, itching, swelling, burning, blisters or another unwanted skin reaction during the test or after it, immediately discontinue use, rinse abundantly with water and consult a doctor. Do not proceed with colouring.

2.4. MI AMANTE LTD. bears no responsibility for allergic reactions, skin irritations or other adverse consequences arising as a result of:

a) a sensitivity test not carried out in accordance with the enclosed instructions;

b) an incorrectly carried out sensitivity test;

c) use of the product despite an observed positive or doubtful reaction in the sensitivity test;

d) use of the product despite the presence of a known hypersensitivity to any of the ingredients indicated on the packaging or in the enclosed instructions;

e) use of the product in violation of the warnings in item 1.2.

2.5. This clause does not exclude or limit the responsibility of MI AMANTE LTD. for established defects in the product itself or for damages due to non-conformity of the product with the applicable safety requirements under Regulation (EC) No 1223/2009.

3. Consultation with a professional

3.1. We strongly recommend that before using colouring products you consult a licensed hairdresser or colourist, especially in the following cases:

•   if your hair is chemically treated (keratin therapy, permanent waving, previous colouring with different products, bleaching);

•   if you are planning significant lightening or a change of tonality;

•   if you have a sensitive scalp, skin conditions or a history of allergic reactions;

•   if you are pregnant or breastfeeding;

•   if you are taking medications that may affect the condition of the hair or scalp.

3.2. We do not recommend the use of permanent hair colours during pregnancy or a breastfeeding period without prior consultation with a doctor. MI AMANTE LTD. bears no responsibility for consequences arising from the use of the product during pregnancy or breastfeeding despite a medical recommendation to refrain from such use.

3.3. MI AMANTE LTD. provides a free telephone consultation with a colourist from the Mi Amante Academy team. The available telephone numbers and the working hours of the consultants are indicated on the product page of the miamantehair.bg site.

3.4. The telephone consultation is based entirely on the information that the user provides about the condition and history of their hair. The consultation does not replace the personal assessment of a specialist who has examined the user's hair and scalp on site. MI AMANTE LTD. bears no responsibility for colouring results in which the information provided by the user was incomplete or inaccurate.

4. Responsibility in case of use by the user

4.1. The colouring products are intended for use with strict observance of the enclosed instructions and the warnings noted on the packaging. The results of the colouring depend on numerous individual factors, including, but not limited to:

•   previous chemical treatments of the hair;

•   natural pigmentation and porosity of the hair;

•   structure and general condition of the hair;

•   percentage of grey hair and its distribution;

•   application technique and thickness of the applied layer;

•   choice of an oxidant with a suitable volume for the respective purpose;

•   time of action;

•   temperature of the surrounding environment during the procedure.

4.2. MI AMANTE LTD. bears no responsibility for unwanted colouring results arising due to actions or omissions of the user, including:

a) failure to observe the enclosed instructions for use;

b) a missed or incorrectly carried out allergic sensitivity test;

c) use of the product on hair with previous chemical treatments without prior consultation with a professional;

d) an incorrect ratio when mixing the colour with an oxidant;

e) an incorrect choice of the oxidant volume relative to the desired result and the condition of the hair;

f)  an exceeded or insufficient duration of action;

g) use of the product by a person who has reported a known sensitivity to any of the ingredients;

h) use of the product in violation of the applicable warnings and contraindications.

4.3. "Unwanted results" within the meaning of item 4.2. are understood to be, without the listing being exhaustive: unwanted colour results, uneven coverage, insufficient coverage of grey hair, a change in the structure of the hair, increased breakage and hair loss, insofar as these have arisen due to the stated actions or omissions of the user, and not due to a defect in the product itself.

4.4. This clause does not exclude or limit the responsibility of MI AMANTE LTD. for defects in the product, nor for damages due to non-conformity of the product with the applicable safety and quality requirements.

5. Responsibility in case of use by a hairdresser or third party

5.1. When the purchased product is used not by the user themselves, but by a third party, including a licensed hairdresser, colourist or other specialist, MI AMANTE LTD. bears no responsibility for the result of the application, nor for errors or omissions in the procedure itself.

5.2. The hairdresser, colourist or other specialist carrying out the procedure bears independent professional responsibility for:

a) a preliminary assessment of the condition of the client's hair and scalp before applying the product;

b) carrying out the mandatory allergic sensitivity test (patch test) a minimum of 48 hours before the procedure, in accordance with the enclosed instructions and the requirements of Regulation (EC) No 1223/2009;

c) the correct mixing of the colour with the suitable oxidant in the correct ratio;

d) the choice of a suitable oxidant volume relative to the purpose of the procedure and the condition of the hair;

e) the observance of the recommended duration of action relative to the specific type and condition of the hair;

f)  adapting the procedure in the presence of previous chemical treatments (keratin, permanent styling, bleaching, previous colouring with other products);

g) informing the client of the potential risks, limitations and possible side effects before starting the procedure;

h) keeping documentation of the carried-out patch test and the informed consent of the client.

5.3. By accepting the General Terms and Conditions when ordering from miamantehair.bg, the user confirms that they are familiar with these special conditions. When providing the product to a hairdresser, colourist or other third party for use, the user undertakes to inform the respective person of the content of these conditions, as well as to provide them with all instructions and warnings enclosed with the product.

5.4. MI AMANTE LTD. is not a party to the legal relationship between the user and the hairdresser, colourist or other specialist who carried out the procedure, and bears no responsibility for actions or omissions of the third party.

5.5. In the case of complaints related to the result of a procedure carried out by a hairdresser or third party, the user should direct their claim to the respective specialist or establishment at which the procedure was carried out.

5.6. This clause does not exclude or limit the responsibility of MI AMANTE LTD. for established defects in the product itself or for damages due to non-conformity of the product with the applicable safety requirements.

6. Right of withdrawal from a contract for hair-colouring products

6.1. The user has the right of withdrawal from a contract concluded at a distance, within a period of 14 days from the receipt of the goods, in accordance with the Consumer Protection Act and Directive 2011/83/EU.

6.2. On the basis of Art. 57 of the Consumer Protection Act and Art. 16, letter "e" of Directive 2011/83/EU, the right of withdrawal does not apply in respect of sealed goods which have been unsealed by the user after delivery and are not suitable for return due to reasons of hygiene or reasons related to the protection of health.

6.3. In view of this, unsealed hair-colouring products from the Mi Amante COLORI line (colours, Oxigen oxidants), as well as unsealed shampoos and masks from the Color Save line, are not subject to return. The right of withdrawal remains in force for unopened products in original, undamaged packaging, provided that the user exercises this right within the statutory 14-day period.

6.4. This clause does not affect the rights of the user in the case of a delivered defective or non-conforming product in accordance with the warranty policy of MI AMANTE LTD. and the applicable legislation.

7. Limitation of liability

7.1. To the maximum extent permitted by the applicable Bulgarian and European legislation, MI AMANTE LTD. bears no responsibility for indirect, incidental or consequential damages arising as a result of the use of colouring products in case of failure to observe the enclosed instructions, the warnings on the packaging or these conditions.

7.2. These conditions do not exclude or limit the statutory rights of consumers under the Consumer Protection Act, the Act on the Provision of Digital Content and Digital Services and on the Sale of Goods and the applicable European legislation, including the right of the consumer to bring claims in case of defective products.

7.3. In the event of a conflict between any clause of this section and a mandatory provision of the applicable legislation, the provisions of the law apply.

7.4. If any clause of this section is declared null or unenforceable by a competent court or authority, the remaining clauses retain their validity and applicability.

VIII. METHODS AND CONDITIONS OF PAYMENT:

- Cash payment: upon receipt of the order from the courier, upon delivery

- Payment by bank card - carried out online through the store, through the Stripe/Shopify Payments payment portal.

1. Grounds and Purposes of personal data processing

 

MI AMANTE LTD. processes (collects, stores and uses) personal data about Customers on the basis of one of the grounds indicated below and with a view to achieving one of the purposes indicated below:

• establishing relationships with new Customers;
• concluding, amending, performing and terminating contracts;
• carrying out communication with Customers.

 

1. Purposes related to the legitimate interests of MI AMANTE LTD., as follows:

 

• internal reporting;
• collection of receivables; and
• activities for carrying out a check upon the return of purchased products or cancellation of a placed order.

 

If MI AMANTE LTD. needs to carry out additional processing for purposes other than those indicated above in this part of the General Terms and Conditions, MI AMANTE LTD. will inform Customers, when obtaining their consent for this is necessary.

 

Due to the nature of the type and volume of personal data collected when using the website of MI AMANTE LTD. outlined above, in the event of non-provision of some or all of them, MI AMANTE LTD. may find itself unable to provide the requested order or service.

Sending informative messages regarding orders, marketing messages and communication.

By accessing the website and/or by completing an order through the online store of MI AMANTE LTD., the user provides their explicit consent to receive marketing and commercial messages from MI AMANTE LTD. through various communication channels, including, but not limited to: electronic mail (email), SMS, mobile messaging applications (e.g. Viber), as well as other suitable electronic means.

The user has the right at any time to withdraw the consent given to receiving such messages through the following means, depending on the communication channel used:

For electronic mail (email) - by clicking the unsubscribe link contained in each message sent;

For SMS messages - by calling the telephone number indicated in the message or using another clearly indicated opt-out method specified in the respective message;

For Viber messages - by using the built-in unsubscribe functionality in the application or by following the instructions indicated in the specific message;

The opt-out from receiving marketing messages should be done separately for each communication channel. After the due exercise of the right of opt-out, MI AMANTE LTD. will cease sending messages through the respective channel within a reasonable period.

In the event that a user exercises their right to erasure of personal data or objects to the processing for marketing purposes, MI AMANTE LTD. will cease the respective processing and will erase the available data, unless their retention is necessary due to the following grounds:

• for compliance with legal obligations arising from the applicable Bulgarian or European legislation (e.g. accounting and tax requirements);

• for the establishment, exercise or defence of legal claims;

• for certifying the lawfulness of the processing in case of an inspection by a competent supervisory authority.

The data retained in these circumstances will be stored solely for the necessary period, determined in accordance with the statutory limitation periods, and will be accessible only to a limited circle of authorised employees.

In order to fulfil the aforementioned purposes, MI AMANTE LTD. may disclose Customers' personal data to the following categories of recipients:

• service providers who carry out services on behalf of MI AMANTE LTD. in or for the purpose of using the website of MI AMANTE LTD.;
• independent agents or intermediaries (distributors);
• commercial partners in or for the purpose of using the website of MI AMANTE LTD. for carrying out orders (courier companies, postal operator, etc.);
• public or judicial authorities, upon request, in and to the extent permitted under the law;
• other controllers on behalf of which MI AMANTE LTD. may process personal data or which are joint controllers with MI AMANTE LTD.;

1. Transfer of personal data outside the European Economic Area (EEA)

MI AMANTE LTD. may carry out international transfer of data originating from the EEA, when the European Commission has recognised a country outside the EEA as ensuring an adequate level of data protection.

 

For transfers to countries outside the EEA whose level of protection is not recognised by the European Commission, MI AMANTE LTD. will rely either on a specific derogation applicable to the particular situation, in accordance with the Regulation, or will apply one of the safeguards provided for by the applicable legislation.

 

In the remaining cases, the transfer of personal data outside the EEA is carried out on the basis of the explicit consent of the Customers to the proposed transfer of data, obtained in compliance with the requirements of the Regulation for this.

 

1. Personal data storage periods

 

MI AMANTE LTD. retains personal data about Customers for the longer of the periods necessary either for compliance with the applicable laws and subordinate normative acts, or another period in accordance with the requirements applicable to the activity of MI AMANTE LTD. The processing of personal data is based on the principle of data minimisation, depending on and for the purposes of the orders placed by the Customers. Part of the data may be stored even after the completion of the order requested by the Customer for the purposes of fulfilling the legal obligations of MI AMANTE LTD. or for the purposes of the legitimate interests of the company.

 

1. Rights of the subjects in connection with the protection of personal data

 

In accordance with the applicable regulatory requirements, the Customer has the right to: 

 

• information, upon the collection of personal data from them or from third parties;

 

• the right of access to their personal data and more specifically: (i). confirmation of whether personal data about them is being processed by MI AMANTE LTD.; (ii). the provision of access to the data through a copy of the data that is being processed, as well as information regarding the purposes of the processing; the categories of personal data; the recipients or categories of recipients to whom the personal data have been or will be disclosed; the storage periods of the personal data; the existence of a right to rectification or erasure of personal data or restriction of the processing of personal data, or to objection to the processing; the right to lodge a complaint with a Supervisory authority (which in the Republic of Bulgaria is the CPDP); the sources of the personal data; the existence of automated decision-making, including profiling.

 

• the right of rectification - to require the rectification or completion of their personal data, if it is inaccurate or incomplete;

 

• the right to erasure of the personal data, when the grounds provided for in the applicable legislation are present;

 

• the right to restriction of the processing;

 

• the right to data portability;

 

• the right to object;

 

• their right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects or otherwise significantly affects them;

 

• giving, changing or withdrawing consent to the processing of personal data, when the ground for the processing is their consent.

 

Customers can exercise their rights by submitting a written application to MI AMANTE LTD., in one of the following ways:

 

• by email to the company's email address indicated above through a qualified electronic signature, in accordance with the Electronic Document and Electronic Trust Services Act;

 

• by post to the company's customer contact address with the sending of a notarised application for the purpose of ensuring identification of the applicant. In cases where the application is submitted by a legal representative of the applicant, or through a representative of the applicant authorised by a notarised power of attorney, the application should also contain the notarised signature of the person who signed on behalf of the applicant.
